October 23, 2008 -- The Federal Trade Commission announced yesterday it will wait six months before enforcing the Red Flags Rule which requires automotive dealers and other companies to deal with identify theft. The original enforcement date was November 1 but under the delay organizations falling within the Red Flags Rule requirements now have until May 1, 2009 to develop and implement a written identity theft prevention program. However, the change in implementation dates does not affect the address discrepancy rule, which continues to have an effective date of November 1. Dealers who have already implemented their identify theft programs are not required to make any changes in their existing systems. ISIADA notes that the new date impacts only the effective enforcement date and is not a suspension of the Red Flags Rule requirements. Please contact us at trex@isiada.com if you have any questions.
The 4th Qtr ISIADA Dealer Continuing Education class, will held at East Idaho Auto Auction located on US 26, east of Blackfoot on Thursday, November 20 2008. The hours will be 1P-5PM. This will be a new class that will cover the new FTC "RED FLAG" rule. We will also produce a refresher on the FTC "SAFEGUARD RULE" that deals with the requirements to protect, store and properly dispose of the personal information that dealers collect from consumers. We will also discuss the FTC " GRAHAM-LEACH BLILEY PRIVACY DISCLOSURE" requirements on consumer privacy non-public information disclosures as well as the FIN CEN 8300 cash handling/reporting requirements. The next ISIADA continuing education class in eastern Idaho will be in April 2009 during the annual Regional Meetings.
